Nederland March Police Reports

In the month of March, there were 28 non-traffic violations, 6 city ordinance violations, 6 parking tickets, 5 miscellaneous violations, 2 other state law violations, and 1 traffic city ordinance violation.

On March 7, a Nederland Police Department officer received a walk-in report of a stolen bicycle. The bike is described as a red, gray and black Giant brand. It had been left at the RTD parking lot and when the person who left the bike at the RTD returned, the bike was gone, even though it had been secured with a cable lock. The lock had been cut.

Another bicycle was also stolen on the same day from South Jackson Street. This bicycle, a Backwoods GT was taken from the outside of the house and had not been locked, but had been left next to the back door. Later the owner reported that his bike had either been misplaced or returned.

On March 7, the NPD was sent to investigate a report of a rollover accident.

When the officer arrived at the scene of the accident the Nederland Fire Protection District EMTs were talking to the driver and noticed he had an odor of alcohol on his breath. He said he had two beers and a shot of tequila. After a roadside test the officer determined there was not enough evidence to charge the driver with a DUI. He was issued a summons for careless driving, no proof of insurance and not wearing his seatbelt. He was given a ride home after the vehicle was towed away.

On March 12, two NPD officers heard a disturbance break out at the Frozen Dead Guy Days festival area. When one of the officers approached the suspect the man grabbed the officer by the shirt and neck. The officer freed himself from the suspect who walked away. When officers stopped him, he was verbally antagonistic towards the officer.

The suspect had a Failure to Comply out of the Boulder County Sheriff’s Office. He was placed into custody and transported to the BC Jail. When they arrived at the jail, the man said his knee was hurting and he was taken to the hospital. The man was medically cleared for his trip back to the jail.

On March 13, an officer on patrol noticed a vehicle in the roadway, the engine was running and a female was sleeping in the driver’s seat. The officer knocked on the window to wake her up and she opened and closed the door, tried to start the car while it was running and began to talk but didn’t make sense. There was an odor of alcohol in the car. The officer asked for her registration and insurance, but they were expired. She said she had three beers. She performed roadside maneuvers in a manner that indicated she was under the influence of alcohol and/or drugs and was unable to safely operate a motor vehicle. She was arrested for driving under the influence. She refused to take a chemicals test and was transported to the Boulder County Jail and booked on DUI.

On March 3, a woman reported the tab of a 2016 license plate was removed from the plate. The vehicle had been parked in the resident’s driveway and no other property was missing. The case is closed but subject to being reopened if new information develops.

On March 10, around 1:30 a.m. a Ned officer was dispatched to investigate a report of a physical domestic disturbance. The witnesses said a man had hit a female and was being restrained by two roommates. When the officer arrived, a man met him, saying “He has been hitting her, man. We had to take him down.” He said the suspect was upstairs in the bedroom.

When the office entered the kitchen, he saw a female who appeared upset. She had tears in her eyes. The officer was met by a man who told him to be careful, that the suspect had just punched him in the jaw. The officer entered the room and saw a man with scratches on his back, no shirt and multiple tattoos. He was mumbling about taking out the trash. His pupils were large and he smelled like alcohol.

When backup arrived, the officer talked to the witnesses and the victim. She said she had come home when the suspect came downstairs and slappeded her two or three times in the head and face with an open hand. He also had his hands on her throat and she felt he was trying to kill her. The roommates restrained the man.

The woman said she did not want medical attention, but she had been scared for her life. The witness did not want to pursue charges for the punch.

When questioned the man said he was just trying to protect his wife and admitted to taking Xanax and drinking alcohol. His behavior was becoming volatile and unpredictable. The suspect was taken into custody and transported to the Boulder County Jail, where he had to be restrained by more deputies. He then head butted the glass window of his holding cell causing it to break. He was placed in a entrant chair and spit hood. He was charged with domestic violence and assault in the third degree.

On March 10, a NPD officer was en route to the jail when he saw headlights of west bound vehicle in the east bound lane. The vehicle was not moving and had visible damage on the roof and windshield. The officer saw a male slumped at the wheel. The engine was running and music was playing. The driver did not respond even when the officer performed a sternum rub.  He still did not respond. The officer reached over to turn the ignition off and saw that the man’s foot was on the brake, and then the vehicle began to roll as the officer was in the open door area. The driver woke up but made no attempt to stop the vehicle forcing the officer to push the man’s knee down to apply the brake.

As the man tried to put the vehicle in park it began rolling backwards. The officer was worried that it would pick up speed and roll into the creek. He was about to pull the man from the vehicle when the driver managed to apply the brake again. There was a strong odor of alcohol coming from his breath. The officer could not get to his radio to update the accident report to a possible DUI and he needed to stay in the driver’s door area to prevent a serious incident.

When a BC deputy arrived on the scene, the two officers got the wheel blocked using a rock. By this time, the NPD officer’s arrestee was shouting from the back of the vehicle. The officer let the deputies deal with the man in the vehicle and he continued to the jail.

On March 21, an officer on patrol noticed a male and female walking east toward the highway. The officer asked them where they were going to stay for the night and they said with a friend. When the officer learned the man’s name, he knew there was a warrant out for the man’s arrest and the woman also had a warrant out for her arrest. The couple was transported to the Boulder County Jail and booked in on charges of Failure to Appear on a preliminary hearing with an original charge of possession of a controlled substance and for pawn broker violation.

On March 29, a woman and her roommate came to the NPD to report a violation of protection order. The officer recognized the woman as one who had been involved in a domestic violence case in January. The woman reported that the man had violated the TPO. The woman said that the man had returned to the house a few days after being arrested and told her roommates that he was on the lease and was living there. The woman was gone on a business trip and he moved back in. Officers looked for the man who was not there and told the woman she could return. A warrant will be requested for the arrest of the man if he is not located prior to the issue of warrant.
