I have learned, since writing my last Letter to the Editor that Trump was not convicted of rape. He was “found liable” in civil court for sexual abuse in the E. Jean Carrol case in New York City. The level of proof required for this civil finding is “a preponderance of evidence” which is different from a criminal trial which requires proof “beyond a reasonable doubt”. He was then found guilty of defaming her. She was awarded $5 million in damages.
Because he continued to spout off about her, the judge found his comments libelous. A 2nd trial on these charges is set for January. The jury of nine private citizens found that Trump had acted “maliciously, out of hatred, ill will, spite or wanton, reckless or willful disregard of the rights of another.”
