The Boulder County Commission approved amendments to the short-term rental policy at a regular meeting on January 30, 2024. Staff Planning Member Ethan Abner presented the amendments.
He requested approval for text amendments to the Land Use Code related to Short-Term Dwelling and Vacation Rentals addressing the licensing of Short-Term Dwelling Rentals and Vacation Rentals within the Unincorporated Area of Boulder County.
Staff had identified two items requiring clarification, and the Board of County Commissioners was asked to approve these changes to the amendments to the Licensing Ordinance as made by the Board of County Commissioners on January 9, 2024.
On January 9, the Community Planning & Permitting Department presented text amendments to the land use code related to short-term dwelling and vacation rentals and an ordinance for the licensing of short-term dwelling rentals and vacation rentals within the Unincorporated area of Boulder County.
Abner said the licensing ordinance is not for the city or towns, but only in unincorporated Boulder County. Short-term rentals are those for fewer than 30 days, where the owner is present in the residence. These facilities can’t be marketed for weddings or events.
Vacation rentals are those located only in forests and mountain areas, without a site plan review.
The County will have a cap on vacation rentals. The Planning Commission approved allowing vacation rentals that are not in subdivisions. These would be for no more than 45 days for short-term rentals and six months when the owner is the primary resident.
After Commissioner discussion and comments from 38 people, at 8:59 p.m., the Commission approved both amendments.
On January 30, new amendments included allowing short-term rentals in the subdivisions in upper St. Vrain. Commissioner Claire Levy asked that language be included that owners have to post the license on the property.
