Black Hawk City Council approved leasing property on Gregory Street to the Woodbury Collective during a regular meeting on September 8, 2021, at 211 Church Street. The Council also excluded City-owned property from the Timberline Fire Protection District, approved the enhanced sales tax incentive program agreement with Monarch Growth, Inc., and appointed a director to the Board of the Black Hawk Business Improvement District.
Finance Director Lance Hillis presented a resolution approving the commercial lease with the Woodbury Collective Corporation for the Property at 327 Gregory Street, Black Hawk. The commercial lease has a term of 40 months, expiring on December 31, 2024.
The monthly rent of $1,142 is based on 50 cents per square foot. This lease includes a rent credit for anticipated disruption due to adjacent construction, an allowance for tenant improvements, and standards of operations, including expected minimum operating hours.
According to the lease, the tenant must use and occupy the premises for a retail establishment, as well as a studio, workshop, classroom, and other associated permitted activities. The premise consists of about 2,283 square feet of space, including 1,361 square feet on the first floor and 922 square feet on the second floor.
City Attorney Corey Hoffmann introduced a resolution authorizing filing a petition for the exclusion of Cityowned property from the Timberline Fire Protection District. Proximo Distillers, a Colorado limited liability company and the City of Black Hawk requested that the Timberline Fire Protection District exclude the real property within the right of way of Lake Gulch Road from the boundaries of the district. The Council approved the resolution.
Hillis introduced an ordinance approving the enhanced sales tax incentive program agreement between the City and Monarch Growth, Inc. On April 1, 2014, the City’s registered voters approved a ballot question obligating the City to share with Monarch Growth, Inc., the developer, the City’s 4% sales tax generated from lodging sales, up to an amount not to exceed $2,700.
With the Certificate of Occupancy obtained by Monarch Growth on August 31, 2021, all the requirements placed on the developer have been satisfied. The enhanced sales tax incentive program agreement details the terms and conditions including a maximum repayment period of 15 years or reimbursement of $2,700, whichever occurs first. The Council approved the ordinance.
The Council also approved an ordinance appointing a director to the Board of the Black Hawk Business Improvement District (BID) and the Silver Dollar Metropolitan District. The BID appointed Norris Hamilton to the Board as the designated elector of Isle/ Lady Luck Casinos to the BID Board. Hamilton replaces Ken Ostempowski.
Hamilton is a Colorado registered voter and was confirmed by the BID Board at its June 22, 2021, meeting. The appointment includes a resolution authorizing the mayor to execute a quitclaim deed on behalf of the city to a newly registered elector qualified to serve on the Silver Dollar Metropolitan District.
Hoffmann said the same individual appointed to the BID is qualified for the Silver Dollar Metropolitan District and will receive 1% interest in property in the District, and then that interest reverts back to the City after he is no longer qualified to be a director.
