John Scarffe, Nederland. Knotted Root Brewing Company in Nederland will get a new outdoor patio after the Nederland Board of Trustees approved the application during the Board’s regular virtual meeting on May 19, 2021, at 7 p.m. The Board also approved the Solarize Nederland Town Rebate, a request to waive the restriction on conveyance and issuance of building permits in the Pine Grove Addition, adopted the 2020 National Electric Code, and amended IRC Requirements based on Location in Wildfire Zones.
Knotted Root Outdoor Patio. Town Clerk Miranda Fisher introduced a Public Hearing and Special Review Use (SRU) Application for an outdoor patio at the Knotted Root Brewing Company, 250 N Caribou Street, submitted by Chris Marchio, the representative for Neverland Real Estate Holdings, which owns the property.
Marchio proposes to construct an outdoor patio for his business’ patrons, according to the agenda information memorandum. The applicant purchased the property in March, 2017, which is zoned General Commercial (GC).
The proposed use is under the Commercial Use groups for “outdoor sales, eating and drinking, or other outdoor commercial activities or establishments,” which is allowed via SRU in the GC district. According to the memorandum, The parcel is 12,958 square feet and the building occupies 2,970 square feet.
The applicant has a wholesale manufacturing and retail sales room license with both the Colorado Liquor Licensing Authority and the Town of Nederland. When Knotted Root submitted an application with the state, the patio area was included in the building footprint. The Planning Commission approved the Special Review Use Application.
Fisher told the Board it is important to note that Knotted Root had an outdoor patio for a year with no complaints, but there have been concerns about parking. Knotted Root has 24 on-site parking spaces. They have been creative in addressing these issues, and will have a parking attendant and are in communication with the Presbyterian Church across the highway. They plan for the patio to have a wooden fence with access, and party lighting that will be turned off when the patio is closed. The Police and Fire departments had no major concerns.
Chris Marchio said he is excited at this prospect of growing the footprint. He has put in the time and effort to be sure this is comfortable for the neighborhood. The footprint of the patio is pretty much the same as it has been.
They propose occasional events such as a July 4 holiday as well as other events, and they might make custom mugs and special beers. They will have more customers than they have currently. They could have acoustic music, but it wouldn’t be very loud, and they would give neighbors notice.
Trustees said it is a successful business bringing a lot of interest to the Town. They didn’t see any issues. The Board received 29 public comments in favor of the application and none against, so the Board approved the SRU application unanimously.
Solarize Nederland. Nederland Sustainability Coordinator Garrett McDaniel said the Town of Nederland seeks Board approval of a resolution allocating $10,000 to the Solarize Nederland program, which will be used for a rebate for participants. He has discussed this at several past meetings.
Custom Solar was selected as the solar installer through a competitive bid process facilitated by the Nederland Sustainability Advisory Board. Custom Solar is offering a tiered rebate that increases depending on the amount of solar that gets installed.
A Tier 3 rebate offers the maximum savings for participants. It requires the installation of 150 kW of solar. To encourage participation in the Solarize Nederland program, the Sustainability Advisory Board would like the Town to provide an additional rebate.
The Town’s rebate would match Custom Solar’s rebate. The last day for participants to sign up for Solarize Nederland is June 30, 2021. He has 14 people interested so far.
The Board approved the resolution.
Pine Grove Replat. The Board considered a request by Rachael Weaver and agent Wendy Williams requesting to waive the restriction on conveyance and issuance of building permits on lots in the Pine Grove Addition. Williams had contacted the Town about 551 W. Pine St., pointing out that the 2006 Subdivision Replat had language restricting conveyances and issuance of building permits “until all Town facilities are completed, including but not limited to sidewalks, gutters, and curbs,” according to the memo.
Weaver and Williams are requesting that the Board of Trustees waive this restriction at this time. Thas has been done in the past: at a regular meeting of the Nederland Board of Trustees on May 2, 2006, the Board approved a lot line dissolution in the Pine Grove Addition. The purpose of the lot line dissolution was to combine the three lots.
Since the approval of the lot line consolidation and the Replat, the ownership of 551 W. Pine Street has been transferred three times. The Town has no indication that the property owner sought approval from the Board of Trustees for these transfers and no record that the Board of Trustees opposed the transfer of ownership.
Weaver, the property owner of 551 W. Pine Street, desires to sell her property and has requested documentation of a waiver of the language on the replat restricting conveyance and issuance of building permits. Because this restriction has not been enforced in the past, the restriction language on the plat is not signed and has no clear indication of the required improvements.
Town staff and the Town attorney support a waiver of the restriction on conveyance and issuance of building permits on Parcels A and B of Nederland Pine Grove Replat. The Board approved the waiver.
The Board also adopted the 2020 National Electric Code and the IRC Requirements based on Location in Wildfire Zones.
