The Central City Council meeting was called to order on November 15, 2022, at 7:02 p.m. In attendance were Mayor Jeremy Fey, Mayor Pro Tem Judy Laratta, Alderman Jeff Aiken and Alderman Jill Story. Alderman Kara Tinucci was absent.
Resolution No. 22-42: This Resolution ratifies the approval of the Release of Declaration of Restrictive Covenants and Regulatory Agreement for Gold Mountain Apartments. The Issuance was issued in 1996 for the principal amount of $9,250,000 to allow 40% units to be occupied by low-income residents. The bonds have been redeemed and paid in full as of November 15, 2022. The Council approved the Resolution unanimously.
Ordinance No. 22-10: This Ordinance approves the sale of City-owned property located at 130 Main Street (commonly referred to as “Scarlet’s Casino”) to RCI Holdings, Inc. for the sum of $2.4 million. The Ordinance was approved on its first reading on November 1, 2022. A Public Hearing was held, but there were no comments. The Council approved the Ordinance unanimously.
Resolution No. 22-41: This Resolution approves an agreement to Furnish Augmentation Water with Albert Frei and Sons, Inc. Public Utilities Director Jack Beard explained to Council the original agreement was made in 1998 and expired in 2018. A new plan to renew the agreement is for the next ten years. Alderman Aiken inquired about the item #7 on the agreement that allows Frei and Sons to go to court to alter the agreement to serve their needs. Aiken wanted to know what would happen in case of drought. Attorney Andrea Benson clarified this was an appropriate stipulation in the agreement. The Resolution was approved unanimously.
Ordinance No. 22-11: This Ordinance includes Young Ranch into the boundaries of the Central City Business District. A first reading was held with the second reading and public hearing to be held on December 6, 2022. City Attorney Marcus MsAskin told Council Young Ranch Resource, LLC petitioned to be included in the Business Improvement District (BID) and will go into the BID records if approved. Alderman Jill Story disagreed with the planned quarry going into the property and expressed disapproval of the Ordinance. McAskin pointed out the agreement for the Annexation of the quarry had already been voted on and approved. This Ordinance had only to do with the BID inclusion. Mayor Fey added the consideration to include the whole property in the BID agreement that was debated previously and he thanked the staff for working out the details before it got to their desk. The Ordinance was approved unanimously.
Ordinance No. 22-12: This Ordinance amends the Central City Municipal Code to impose an annual gaming device fee for $150. City Manager reported this fee is separate from the $1,300 Occupational Tax that was recently approved by a majority of registered voters in the November 8, 2022, election. Mayor Fey thanked the voters for approving the tax. A second reading and public hearing will be held on December 6, 2022.
Staff Updates: Daniel Miera reported the President of the Belvidere Foundation signed a contract on November 15, 2022, and it was sent to Palace Construction to begin the repair on the roof of the Belvidere. Miera will inform the Council when they have a notice to proceed.
Council Comments: Mayor Pro Tem Laratta was happy with the results of the election and thanked everyone who voted. Alderman Aiken also thanked the voters. Alderman Story congratulated Mayor Fey on his re-election and congratulated Marcia Enlow and Todd Williams on their election win to serve as Alderman. Mayor Fey stated there was exciting movement in the City and their neighbors. He announced there will be a Community Potluck at the Teller House following the tree lighting ceremony on Main Street to kick off the Tommyknocker Holidays on December 2 at 6:30 p.m.
Public Comment: Barbara Thielemann announced the Gilpin Arts Annual Fundraiser will be on November 19. The Turkey Trot Dance hosted by the Belvidere Foundation will be that night at the Elks Club. She also announced Gilpin School students will be at the Teller House on December 1 for a celebration and they will put homemade decorations on the Christmas tree. The Community Dinner on December 2 at the Teller House will include a performance by the Peak to Peak Chorale.
