On Tuesday, January 9, 2024, the Gilpin County Commissioners again selected The Mountain-Ear as newspaper of record for 2024.
This is an honor that we accept with gratitude. The commissioners spoke kind words about both The Mountain-Ear and the Weekly Register Call (WRC). The WRC had also applied to be Newspaper of Record.
So here’s where I want to say a few very kind words about WRC. While it was not selected to be the Newspaper of Record, I do believe the WRC has a very important role in Gilpin County. They do reach readers that we don’t reach, whether it’s readers that don’t like our “more extensive” coverage of the Peak to Peak region, or perhaps readers that simply don’t want to read two newspapers that have “some of” the same coverage. Either way, I personally want to recognize WRC and their continued devotion to covering the news of this region. As well, their historical archive is invaluable to the community for over 160 years of life in Gilpin County.
Now I want to clarify a few things mentioned in their editorial a few weeks ago. And clarify why we can be a Newspaper of Record.
The Mountain-Ear is owned by a limited liability company. The Mountain-Ear has 3 offices. We have a leased space at 430 Lawrence Street, unit C, in Central City. I maintain my home office at 245 Apollo Drive, in Black Hawk. And we have our office at 98 W. 1st Street, in Nederland. Our Nederland office is listed as our “principal” with the Colorado Secretary of State, which allows an entity to list only one “principal” office. The very use of the word “principal” in the LLC statute implies an entity may have other offices that are not listed as its “principal” office. The statute that governs registration of LLC’s has nothing to do with where a newspaper is “published.” They are two separate things. They are not even located in the same title of the statutes.
Section 24-7-101, C.R.S. provides “Published” means a newspaper that maintains an office in the county to gather news, sell advertising, or conduct business of newspaper publications.” (Emphasis added). The statute does NOT say, “maintains its sole office," “maintains its only office,” or “maintains its principal office.” The Mountain-Ear maintains “an office” in both counties and is therefore published in both Boulder and Gilpin counties. The statute is clear. We are PROUD to be YOUR community source for news, since 1977. Thank you for your continued support.
