Gilpin County Sheriff’s Deputy Filip Perry is under investigation for using too much force in the arrest of Daniel O’Donnel.
According to Cherokee Blake with the Sheriff’s Department, on Monday, June 26, 2023, the Gilpin County Sheriff’s Office opened an officer misconduct investigation involving Deputy Filip Perry. The incident occurred at 12:23 a.m. on June 25, 2023, when this deputy contacted a suspect for a complaint of road rage.
While Deputy Perry was speaking with the suspect, he determined from his observations that he needed to conduct a DUI investigation. The deputy requested that the suspect exit the vehicle, and then the suspect became uncooperative, and Deputy Perry requested law enforcement backup. A physical and verbal altercation then ensued between the suspect and Deputy Perry.
Other law enforcement personnel responded, and the suspect was arrested.
Deputy Perry reported this incident to his supervisor immediately after it occurred and while still on scene on June 25, 2023. He told the supervisor that making inflammatory and inappropriate statements to the suspect was wrong.
Deputy Perry was counseled by his supervisor and instructed that the conduct Deputy Perry demonstrated in this incident does not meet the expectations of this office. Deputy Perry agreed with this initial on-scene corrective action.
Later Deputy Perry stated his actions did not meet his own expectations, nor those of his trainers, supervisors, the Gilpin County Sheriff’s Office, or the profession as a whole.
Daniel O’Donnell was arrested but is not in Gilpin County jail. The Sheriff’s Department and Sheriff Kevin Armstrong are not able to talk about the investigation because it is ongoing.
